INVESTORS TERMS & CONDITIONS

The Vendor reserves the right to alter the specifications referred to in this website without prior notice.

SUB AGENTS TERMS & CONDITIONS
WHEREAS:
(1) Property Packaged is authorized to sell properties in various parts of the world on behalf of certain developers for the promotion and sale of those properties to persons in various parts of the world.
(2) The “Sub Agent” shall be one of a network of “Sub Agents” each of whom will find purchasers of properties and introduce these purchaser to Property Packaged.
APPOINTMENT
(1) Property Packaged hereby appoints the “Sub Agent” to promote and solicit purchases for those properties listed by Property Packaged and the “Sub Agent” agrees to conduct business within all terms and conditions as instructed by Property Packaged and the “Sub Agent” accepts the appointment on those terms.
(2) The “Sub Agent” shall not, either on its own behalf or on behalf of any other company or third party be involved directly or indirectly with the developer of the introduced properties
(3) The “Sub Agent” shall have no authority to negotiate prices without prior agreement of Property Packaged.
(4) It is agreed that the “Sub Agent” is self employed and only affiliated with Property Packaged as described within this agreement. “Sub Agents” are not employees, agents or partners of Property Packaged. A “Sub Agent” is not authorized to incur any liabilities or conduct business directly on behalf of Property Packaged and must not purport to do so. As acting as a “Sub Agent” you are responsible for your own business decisions and are responsible for all expenses you incur in running your own business. Except to the extent that it is contrary to the terms of this agreement or the current Policies and Procedures you are entitled.
(5) As an “Sub Agent” you are entitled to arrange for such assistance in the conduct of your business as you consider appropriate, to be provided to you by such persons as you choose, and to delegate the performance of your obligations to those persons. You are responsible for the expense of engaging or employing those persons.
BUSINESS CONDUCT
(1) Property Packaged reserves the right to immediately terminate this agreement with the “Sub Agent”, in case of any misconduct of the “Sub Agent”, which may harm the business activities, image or perception of any third parties thereof, by stating false claims of any kind about the business or the company, or any other activities or remarks / statements, which may cause harm to the company or any other party associated to Property Packaged.
(2) Property Packaged WILL NOT tolerate SPAM MAILING and if found doing so will automatically have there contract terminated with Property Packaged.
CONDUCT OF YOUR BUSINESS AND THE POLICIES AND PROCEDURES
(1) As a “Sub Agent”you agree to comply with the terms and conditions set out in within this agreement.
(2) It is for the mutual benefit of your business and that of Property Packaged and it’s “Sub Agents” that there is uniformity in these terms and conditions and that they reflect the practice which will best enable the growth of all related business to enhance and protect their reputation, so as a “Sub Agent” you agree that Property Packaged has the right to change these rules at any time and you agree to comply with those terms and conditions as amended and that they form part of this agreement.
(3) In addition to complying with the current version of the Terms & Conditions in the conduct of your business you agree:
i. Not to deal, work with or communicate directly with the developer, homeowner or real estate agent involved in any manner with the properties listed through Property Packaged unless agreed firstly with or by Property Packaged. Failure to do so would be a breach of this contract agreement and Property Packaged holds the right to review all legal options against you with regards to the breach of contract.
ii. As a “Sub Agent” you are not to make any statements or warranties that are untrue or deemed unethical regarding the business or its related services and products and in addition you not to misrepresent or exaggerate any business related services or products.
CANCELLATION OF CONTRACT
(1) As an” Sub Agent” you have the right to terminate your appointment at any time without charge. Property Packaged advise you to use the "Remove Me" section of the system to make sure your details are no longer listed with Property Packaged.
PROPERTY PACKAGED INTERNATIONAL’S INTELLECTUAL PROPERTY & RESTRICTIONS ON COMPETITION
(1) As a ”Sub Agent” you may use the Property Packaged name in respect of your business that relates to Property Packaged only and only in accordance with the terms of this agreement.
(2) As an” Sub Agent” you agree that the names, addresses and contact details of any client, enquiry, third party or other “Sub Agent” and all other information provided to you through Property Packaged is strictly confidential, and will only be used by you for the purpose of your Property Packaged business. Failure to do so would be a breach of this contract agreement and Property Packaged holds the right to review all legal options against you with regards to the breach of contract.
(3) Whilst you are a ”Sub Agent” you agree not to compete with Property Packaged, unless agreed in writing by our office that you are able to conduct business in this manner.
OTHER PROVISIONS
(1) You have no financial obligation as a Property Packaged “Sub Agent” from the commencement of this agreement.
(2) This agreement is governed by and is constructed in accordance with the English law and the parties hereby submit to the exclusive jurisdiction of the English Courts. You undertake as a “Sub Agent” that you are not relying on any statements or comments from Property Packaged except as set out in this agreement.
(3) If any provision of this agreement is held by a court to be illegal, unenforceable or invalid in whole or in part the reminder of that provision and all other party of this agreement will continue to be binding and have effect.
(4) Any notice you wish to send to Property Packaged should be sent to our stated address. Any notice which Property Packaged wished to send you will be sent to your address confirmed on your application or to any other address which you have notified Property Packaged should be used in it’s place.
(5) All personal information given by you to Property Packaged including sensitive personal data (as defined in the Data Protection Act 1998, if any) will be retained by Property Packaged on a computer database and used by us for the purpose of it’s business and to also keep you informed and updated about services via email. You agree that Property Packaged may disclose this information to third parties as it sees fit, including companies outside the European Economic Area with which we are associated. These countries my not have laws to protect your information, details of the companies and countries involved will be provided on request. You consent to us retaining, processing and disclosing your personal information in this matter.
CONFIDENTIALITY OF PROPRIETARY INFORMATION & SOFTWARE
(1) You agree that during and after the term of this Contract not to reveal confidential information, or trade secrets to any person, firm, corporation or entity. The Company shall formally introduce you to the relationships, contracts and companies, to enable you to have the ability to conduct the business and shall, in good faith, facilitate and not approach these relationships, contracts or companies directly to conduct any business during this contract. Property Packaged holds the right to review all legal options against you with regards to the breach of contract.
PROPERTY PACKAGED RIGHTS AND OBLIGATIONS
(1) Property Packaged will provide property listings, e- marketing material and e-brochures when available.
(2) Follow up leads provided by the Agent in order to make sales of properties on behalf of the “Sub Agent”.
(3) Fully Support all “Sub Agents” & Maintain the up keep of the website.
(4) Pay the “Sub Agent” commission in respect of completed sales through the agent.
COMMISSION & PAYMENTS
(1) Property Packaged pays commission to “Sub Agents: as soon as the commission has been received by our office, normally 30 working days later.
AGREEMENT COMMENCEMENT
This agreement comes into effect once you've complete and submitted the Sub Agent Application form.
